The family of a 12-year-old girl critically injured during a tragic school shooting in Tumbler Ridge, British Columbia, has initiated a civil lawsuit against OpenAI. Filed in the B.C. Supreme Court, the claim by Cia Edmonds on behalf of her daughters, Maya and Dahlia Gebala, alleges that the tech giant failed to alert authorities about the shooter’s violent intentions, despite having prior knowledge of concerning interactions with its AI chatbot, ChatGPT.

Allegations of Negligence

The lawsuit draws on various media reports and statements from public officials, asserting that OpenAI was aware of the potential for violence months before the horrific incident on February 10. It has been reported that the shooter, Jesse Van Rootselaar, engaged with ChatGPT in June, discussing violent scenarios over several days. Although these communications were flagged by OpenAI’s automated systems as problematic, the company did not inform law enforcement.

“The purpose of this lawsuit is to learn the whole truth about how and why the Tumbler Ridge mass shooting happened, to impose accountability, to seek redress for harms and losses, and to help prevent another mass-shooting atrocity in Canada,” states the law firm representing the family, Rice Parsons Leoni & Elliott LLP.

The Impact on the Victims

Maya Gebala was shot three times at close range, sustaining severe injuries, including a catastrophic brain injury. The civil claim details that one bullet penetrated her skull, while others caused damage to her neck and face. As a result, she has endured permanent cognitive and physical disabilities, including right-sided hemiplegia, along with psychological trauma manifesting as depression, anxiety, and post-traumatic stress disorder (PTSD). Currently, she remains in BC Children’s Hospital, with her long-term recovery uncertain.

The Impact on the Victims

In contrast, her sister Dahlia, who was present during the incident but physically unharmed, has also been affected. Dahlia suffers from PTSD, anxiety, depression, and sleep disturbances. Their mother, Cia Edmonds, experiences similar mental health struggles, which have led to a significant decline in her quality of life and economic wellbeing.

OpenAI’s Response and Changes

OpenAI has yet to provide a comment on the lawsuit. However, following the shooting, the company has made certain modifications to its protocols. B.C. Premier David Eby has confirmed that OpenAI’s CEO, Sam Altman, expressed readiness to apologise to the affected families during a recent meeting. Despite this, the civil claim accuses OpenAI of rushing its AI technology to market without sufficient safety evaluations, claiming it was aware of “hazardous defects” in its system.

The lawsuit seeks undisclosed punitive damages, describing OpenAI’s actions as morally reprehensible and detrimental to both the plaintiffs and the wider community. It is important to note that these allegations remain untested in court.
