In a shocking turn of events following the tragic school shooting in Tumbler Ridge, British Columbia, the family of a 12-year-old girl critically injured in the incident has initiated a civil lawsuit against OpenAI. The claim, filed on Monday in the B.C. Supreme Court, seeks to hold the tech giant accountable for its alleged failure to disclose the shooter’s violent intentions to law enforcement prior to the February 10 tragedy.

Cia Edmonds, acting on behalf of her daughters, Maya and Dahlia Gebala, claims that OpenAI was aware of concerning interactions between the shooter and its ChatGPT chatbot months before the fatal event. Reports indicate that the shooter engaged in discussions about gun violence, which were flagged by the company’s automated systems. However, despite discussions among staff regarding the potential risk, OpenAI chose not to alert any authorities.

“The purpose of this lawsuit is to learn the whole truth about how and why the Tumbler Ridge mass shooting happened, to impose accountability, to seek redress for harms and losses, and to help prevent another mass-shooting atrocity in Canada,” stated Rice Parsons Leoni & Elliott LLP, the law firm representing the family.

The civil claim details the severe injuries sustained by Maya during the shooting. She was shot three times at close range: one bullet penetrated her head above the left eye, another struck her neck, while a third grazed her cheek and earlobe. As a result, she has endured a catastrophic traumatic brain injury, resulting in permanent cognitive and physical disabilities, right-sided hemiplegia, scarring, and psychological trauma, including depression, anxiety, and PTSD. Maya remains hospitalised at BC Children’s Hospital, with her long-term prognosis still uncertain.

Dahlia, although physically unharmed, has faced her own struggles, battling PTSD, anxiety, depression, and sleep disturbances. Their mother, Ms. Edmonds, has also reported similar emotional distress, alongside pain and suffering, loss of enjoyment of life, and financial repercussions.

The allegations against OpenAI have sparked a wider conversation about the responsibilities of tech companies in safeguarding public safety. B.C. Premier David Eby, who has met with OpenAI CEO Sam Altman, indicated that Altman is prepared to extend an apology to the affected families. The lawsuit contends that OpenAI rushed its large language model to market without sufficient safety studies, deploying a product that allegedly contained “hazardous defects.”
