Australia’s e-safety commissioner has raised alarms regarding significant shortcomings in social media platforms’ compliance with newly enforced regulations aimed at restricting access for users under 16. This warning comes nearly four months after the legislation took effect, which mandates stringent measures for platforms like Facebook, Instagram, TikTok, and YouTube, or they risk facing hefty fines.
Regulatory Framework and Compliance Gaps
The legislation, heralded as one of the strictest in the world, requires ten major social media networks to implement effective measures preventing under-16s from creating accounts. Non-compliance could lead to fines reaching A$49.5 million (£26.5 million). Despite reports indicating that approximately 5 million accounts have been deactivated since the law’s inception, e-safety commissioner Julie Inman Grant noted in a statement that “major gaps” remain in how these platforms are enforcing the new rules.
Grant expressed concern over compliance monitoring, stating, “While social media platforms have taken some initial action, I am concerned that some may not be doing enough to comply with Australian law.” The platforms’ current strategies have been deemed insufficient, as they reportedly allow children to repeatedly attempt age verification, undermining the intent of the legislation.
Parental Insights and Survey Findings
The implications of this regulatory initiative have been underscored by a recent survey conducted among 900 parents and caregivers. The findings revealed that nearly half of the respondents reported their children held accounts on at least one social media platform prior to the law’s enactment. This figure dropped to around 31% after the legislation came into effect, signalling a significant shift in user demographics.
However, the survey also highlighted that many platforms have not provided effective mechanisms for parents and guardians to report underage accounts. Grant emphasised that the investigation into potential non-compliance by firms like Meta, TikTok, and Snapchat is ongoing, stating, “To demonstrate that companies have not taken reasonable steps to comply with the ban will take time.”

In light of the e-safety commissioner’s concerns, a spokesperson for Meta acknowledged the challenges of accurately determining a user’s age, suggesting that robust age verification and parental approval at the app store level could be the most effective solution. The firm reiterated its commitment to enhancing enforcement measures to detect and eliminate accounts belonging to users under the age of 16.
Grant’s warning to the platforms is clear: compliance is not optional. “We certainly expect companies operating in Australia to comply with our safety laws,” she stated. The commissioner noted that failure to do so could lead to “escalating consequences,” including potential reputational damage that could extend beyond Australian borders.
