The Manhattan District Attorney’s office has initiated an investigation into sexual assault allegations against Eric Swalwell, a Democratic congressman from California who is currently campaigning for the governorship of the state. The inquiry follows claims made by a former staff member, who has alleged that Swalwell assaulted her on two occasions, prompting calls for him to withdraw from the race.

The investigation was confirmed on Saturday, shortly after the San Francisco Chronicle reported that a woman, who previously worked in Swalwell’s district office, accused him of engaging in non-consensual sexual activity in California in 2019 and again in New York in 2024. The accuser stated that she was incapacitated by alcohol during both incidents, rendering her unable to consent.
New York law stipulates that an individual cannot give consent if they are “mentally incapacitated” or “physically helpless” due to substances.
