The Trump administration has stepped in to support Elon Musk’s artificial intelligence venture, xAI, as it faces legal challenges regarding environmental pollution in Mississippi. The Department of Justice (DoJ) has requested a federal court to dismiss a lawsuit initiated by the NAACP, which claims that xAI’s operations are harming local communities through methane emissions from gas turbines.
Lawsuit Overview
The legal action, filed in April by the NAACP, alleges that xAI and its subsidiary, MZX Tech, installed numerous methane-gas turbines to power a datacentre located in Southaven, Mississippi, without obtaining the necessary air permits. The NAACP asserts that these turbines release hazardous pollutants, violating the Clean Air Act, and seeks a court order to cease their operation.
In a detailed memorandum submitted to the court, the DoJ argued that the datacentre plays a crucial role in developing AI models essential for economic stability and national security. They contended that the turbines are vital for powering the facility and that the Clean Air Act permits the termination of citizen lawsuits that threaten national interests.
Adam Gustafson, a deputy assistant attorney general in the DoJ’s environmental and natural resources division, emphasised, “The Department of Justice will not sit idly by while private organisations use environmental laws to undermine our national security.”
The Role of xAI
xAI is primarily centred around its chatbot, Grok, which shares similarities with other AI models like ChatGPT but has faced significant controversy. Concerns have been raised about Grok’s involvement in generating non-consensual deepfakes and inappropriate content, as well as alarming self-references. The DoJ highlighted Grok’s importance to national security, claiming that its military version has successfully assisted US forces in targeting operations.
xAI’s parent company, SpaceX, recently achieved a historic initial public offering, valuing the firm at over $2 trillion and making Musk the world’s first trillionaire. Furthermore, xAI has formed partnerships with major tech firms, including Google and Anthropic, generating billions in revenue through datacentre leases.
Community Response and Environmental Concerns
The NAACP’s legal representatives argue that local communities have a fundamental right to challenge polluters. They assert that the DoJ’s intervention undermines this principle and that all corporations, regardless of their ties to the federal government, must adhere to environmental regulations.
Laura Thoms, the director of enforcement for Earthjustice, which is supporting the NAACP, stated, “There is no moral or legal precedent for this. This isn’t about national security; it’s a desperate attempt to protect wealthy tech companies from obeying the laws meant to protect people from pollution.”
xAI operates two significant datacentres known as “Colossus 1” and “Colossus 2,” with the latter spanning 1 million square feet in Southaven. Both facilities have faced criticism from local residents, particularly from historically Black communities that have long endured the adverse effects of pollution.
The NAACP claims that xAI has unlawfully installed 57 gas turbines at its Southaven site, each comparable in size to large buses. They allege that the datacentre could emit over 5,000 tons of harmful nitrogen oxides annually, in addition to other hazardous pollutants, contributing to severe health issues such as asthma, heart disease, and cancer.
Abre’ Conner, the NAACP’s director of environmental and climate justice, remarked, “Laws like the Clean Air Act are a bedrock insurance policy for communities to hold polluters accountable for decisions that cause them harm. This should not be up for debate.”
