StubHub UK Hit with £900,000 Fine and Refund Order Over Hidden Fees

StubHub UK is facing significant repercussions after the Competition and Markets Authority (CMA) mandated the ticket reseller to refund over 50,000 customers due to the failure to display total ticket prices transparently at the point of sale. The company will also incur a fine of £900,000 as a result of this violation, with each affected customer expected to receive an average refund of £10.

Investigation Findings

The CMA’s investigation revealed that between 6 April and 7 December of the previous year, StubHub UK was not upfront about additional mandatory costs, such as delivery and service fees, which were only disclosed at the final checkout stage. This practice, known as “drip pricing,” misled consumers into believing they were securing a better deal than the actual price reflected.

Emma Cochrane, the CMA’s executive director for consumer protection, emphasised the unfairness of hidden fees, stating, “Hitting customers with hidden fees is illegal. It’s not fair to draw people in with what looks like a good deal, only for them to find the real price is higher when they get to the checkout due to extra charges that can’t be avoided.”

StubHub’s Response

In response to the CMA’s findings, StubHub International attributed the hidden fees to an “isolated platform error” that affected how charges were displayed during the purchasing process. The company has assured customers that it has rectified the issue and that all impacted individuals will receive their refunds automatically.

The CMA noted that StubHub UK admitted to the breach, which allowed them to receive a 40% reduction in the fine. The regulator is actively working to ensure that similar practices are eradicated within the industry.

Rocio Concha, policy director at consumer group Which?, stated the importance of the CMA’s actions, reinforcing that “the law is clear: hitting customers with hidden, extra fees that aren’t clearly disclosed from the start is completely unacceptable.”
