Kimbrelle Kyereh resides mere feet from chemical storage tanks in St. Rose, Louisiana, where the air is often thick with hazardous fumes. The impact on her health has been profound; she has experienced headaches, nausea, and sleepless nights due to the noxious odours that invade her home. In a moment of desperation, she once fled with her son to a nearby diner in the early hours of the morning to escape the fumes.
In response to these persistent issues, Kyereh began collaborating with a local environmental justice organisation to collect air quality samples. However, her efforts were abruptly halted in 2023 following the enactment of a law backed by industry interests that significantly restricted the use of community-collected air data. “I shut my mouth like they wanted me to,” Kyereh lamented, highlighting the silencing effect of such regulations.
Inadequate Monitoring Systems
A recent investigation by Floodlight and the Guardian revealed that Louisiana’s public air monitoring system is severely flawed. Many monitoring stations are situated miles away from the state’s major industrial polluters, failing to accurately assess the toxic air residents are breathing. An analysis of emissions data from the Environmental Protection Agency (EPA) identified the top 25 industrial air polluters in Louisiana, revealing that ten of the most significant emitters operate without any public monitoring stations within a five-mile radius.
For instance, the Dow Chemical facility in Plaquemine is located eight miles from the nearest monitoring station, which only measures ozone levels, neglecting the multitude of hazardous pollutants released by the plant, including ethylene oxide—a known carcinogen. Similarly, CF Industries’ Donaldsonville plant emits over seven million pounds of ammonia annually, yet there is no public monitoring for this dangerous chemical.
Legislative Backlash Against Community Monitoring
The situation was starkly illustrated on 24 August 2023, when a leak at Marathon’s refinery in Garyville resulted in a catastrophic fire. Despite reports of the leak, the Louisiana Department of Environmental Quality took over six hours to begin air monitoring, during which time residents remained largely uninformed. The nearest monitoring station was focused solely on ozone, failing to detect the volatile organic compounds released during the incident. This lack of urgency in monitoring endangered local children, as schools nearby remained open until evacuations were ordered much later.
Community advocates, including environmental health researchers, have long called for improved monitoring, particularly in areas where predominantly Black populations reside. Adrienne Katner, an associate professor at Louisiana State University, has highlighted that nearly 400 high-emission facilities in the state lack public air monitoring. “Communities only learn about toxic releases when there’s a shelter-in-place order or an evacuation,” she stated, calling it “a public health emergency waiting to occur.”
The Industry’s Influence on Policy
Legislative efforts aimed at enhancing air quality oversight have repeatedly failed, primarily due to strong opposition from the petrochemical industry. Former state senator Cleo Fields, who has advocated for better monitoring laws for years, expressed frustration at the industry’s consistent pushback. “Every year this was opposed by industry for no good reason,” Fields noted. Efforts to introduce perimeter monitors at facilities emitting toxic pollutants have similarly been thwarted.
The Louisiana Chemistry Association, representing numerous chemical companies, has played a pivotal role in shaping the restrictive 2024 Community Air Monitoring Reliability Act (CAMRA). This law limits the use of air pollution data for regulatory actions unless collected using EPA-approved monitors—equipment that is often prohibitively expensive for community groups. Critics argue that such measures stifle grassroots monitoring initiatives, exacerbating the risks faced by vulnerable communities.
