A recent ruling by a panel of former judges has led to significant sanctions against four members of Canada’s 2018 World Junior hockey team, following an investigation into their conduct related to a controversial sexual assault allegation. While one player has been reinstated, the others face lengthy suspensions that will restrict their participation in various hockey-related activities, including international competitions.
Findings of the Independent Appeal Board
The five players involved—Michael McLeod, Carter Hart, Dillon Dubé, Alex Formenton, and Cal Foote—were previously acquitted of criminal charges in a 2024 trial concerning an alleged sexual assault that occurred in June 2018. Despite the court’s decision, an independent appeal board commissioned by Hockey Canada has concluded that the players violated the organisation’s code of conduct, which has now resulted in recommended suspensions for four of them.
Hockey Canada confirmed on Wednesday that it has accepted the recommendations of the review panel. Formenton, who has faced accusations since the incident, has been reinstated immediately. In contrast, Foote will be suspended until November 10, 2026, Hart until November 10, 2027, Dubé until November 10, 2028, and McLeod until November 10, 2030. These suspensions will prohibit them from engaging in coaching, volunteering, or representing Canada in international competitions, including the Olympics and world championships.
Details of the Investigation
The independent panel, consisting of former judges John Laskin, Katherine Swinton, and Thomas McEwen, did not provide specific reasons for the differing lengths of the suspensions or Formenton’s immediate reinstatement. Hockey Canada spokesperson Jeremy Knight stated that the findings of the panel would remain confidential, adhering to the terms of the original investigation which sought to maintain privacy.
The investigation uncovered evidence that was not presented during the trial, including statements from the players involved. However, a judge had previously ruled that these statements could not be introduced in court due to concerns over the players’ rights to a fair trial, as they were reportedly coerced into participating under the threat of bans from their sport.
The Aftermath and Current Career Status of Players
The players have faced considerable scrutiny over the years since the allegations first emerged. Following their acquittal, many have attempted to resume their professional careers. Carter Hart, who recently signed a two-year contract with the Vegas Golden Knights, was the team’s starting goaltender during the Stanley Cup final in June. Similarly, Dubé is now with the St. Louis Blues, while McLeod played in Russia’s Kontinental Hockey League last season. Formenton’s career has seen him playing for the Swiss club Ambri-Piotta.
Foote, who played for the American Hockey League’s Chicago Wolves last season, signed with Sweden’s Farjestad BK, but the club later withdrew its offer after receiving backlash from fans and partners regarding the signing.
A Dark Chapter for Hockey Canada
This incident has cast a long shadow over Hockey Canada, culminating in a series of inquiries, including parliamentary hearings that scrutinised the organisation’s handling of the allegations. The original claims surfaced during a Hockey Canada golf tournament and gala in 2018, but the matter only gained public attention in 2022 when Hockey Canada settled a lawsuit with the complainant, a woman identified in court documents as E.M. This settlement occurred without the players’ knowledge, leading to significant public outcry and calls for reform within the sport.
E.M. testified that she had consensual relations with McLeod but later claimed that other players entered the hotel room without her consent. The court ultimately dismissed her allegations, with Justice Maria Carroccia stating that the evidence provided by E.M. was neither credible nor reliable.
Why it Matters
The ruling and subsequent suspensions highlight ongoing issues surrounding the culture of hockey in Canada, particularly regarding accountability and the treatment of allegations of sexual misconduct. This case serves as a reminder of the urgent need for reform within the sport, as it continues to grapple with the implications of past actions and the necessary steps toward creating a safer environment for all participants. The conversation about appropriate conduct and the responsibilities of players, governing bodies, and the broader community remains critical as the sport moves forward from this troubling chapter.
