In a significant legal move, the family of a 12-year-old girl critically injured during the Tumbler Ridge school shooting has lodged a civil lawsuit against OpenAI. The claim was officially submitted on Monday in the British Columbia Supreme Court by Cia Edmonds, representing herself and her two daughters, Maya and Dahlia Gebala. The lawsuit alleges that OpenAI had prior knowledge of the shooter’s violent intentions through interactions with its ChatGPT chatbot but failed to alert the appropriate law enforcement agencies.

The civil claim is built on various media reports and statements from public officials and representatives of OpenAI. It contends that the technology firm was aware of troubling exchanges involving the shooter and its chatbot months before the tragic event on February 10. “The purpose of this lawsuit is to learn the whole truth about how and why the Tumbler Ridge mass shooting happened, to impose accountability, to seek redress for harms and losses, and to help prevent another mass-shooting atrocity in Canada,” stated the law firm Rice Parsons Leoni & Elliott LLP, which is representing the family.

Maya Gebala sustained life-threatening injuries in the incident, having been shot three times at close range. The civil claim details that one bullet penetrated her head above her left eye, while another struck her neck, and a third grazed her cheek and earlobe. As a result, she has endured a catastrophic traumatic brain injury, resulting in permanent cognitive and physical disabilities, right-sided hemiplegia, scarring, and psychological issues, including depression, anxiety, and post-traumatic stress disorder (PTSD). Maya remains in BC Children’s Hospital, with her long-term recovery still uncertain.

Her sister, Dahlia, was present during the shooting but was not physically harmed. However, she is reported to be suffering from PTSD, anxiety, depression, and sleep disturbances. Their mother, Ms. Edmonds, has also experienced similar psychological traumas, resulting in a diminished quality of life and loss of earnings.

OpenAI’s Response and Changes

OpenAI has not yet provided a public response to the lawsuit as of Monday. However, the company’s CEO, Sam Altman, has expressed a willingness to apologise to the families affected by the shooting. Reports indicate that while using ChatGPT, the shooter had engaged in discussions about gun violence over a series of days, which were flagged by the company’s automated review system. Some employees had voiced concerns about the potential for real-world violence during internal discussions, yet the decision was made not to alert Canadian law enforcement.
