A criminal probe has been initiated against two local officials in Crans-Montana, Switzerland, in connection with the devastating bar fire that claimed the lives of 40 young individuals earlier this month. This tragic incident, which also left 116 others injured, has prompted scrutiny over fire safety regulations and the responsibilities of local authorities.

Investigation Details

Documents and reports from local media indicate that the current head of public safety for the municipality has been summoned for questioning, scheduled for next Friday. His legal representative, Nicolas Rivard, confirmed that his client will invoke the right to remain silent during the proceedings. Additionally, a former fire safety officer is set to be interrogated by investigators in Valais on 9 February. Both individuals have been designated as “defendants” in the ongoing investigation, which seeks to determine if the municipality’s officials, both past and present, neglected their safety obligations concerning Le Constellation bar.

The bar, owned by Jacques and Jessica Moretti, is already facing serious charges, including negligent manslaughter and arson. Until recently, the couple was the sole focus of the investigation. The fire, which erupted in the basement of the bar during a New Year’s celebration, has raised critical questions regarding the presence and accessibility of fire extinguishers and the adequacy of exit routes, particularly a narrow staircase used for evacuation.

Tragic Toll

Among the deceased were 21 Swiss nationals, alongside nine French, six Italian, and one each from Belgium, Portugal, Romania, and Turkey. The victims were predominantly teenagers, with an average age of just 19. Initial investigations suggest that the blaze was ignited by sparklers that were held too close to a ceiling covered in highly flammable soundproofing foam, leading to a rapid and uncontrollable spread of fire.

Further complicating matters, the local mayor, Nicolas Féraud, acknowledged that the municipality had failed to conduct the mandatory annual safety inspections of the bar since 2019, a revelation that has sparked public outrage and calls for accountability.

Seeking Accountability

The ongoing investigation aims to clarify the circumstances surrounding the fire and assess the adherence to health and safety regulations. It also seeks to establish any potential criminal liability among the owners, staff, and local authorities. Prosecutors have denied the municipality’s request to join the case as a party, which would have granted it equal standing with the victims’ families.

A prosecutor’s document emphasised that there is reason to believe the municipality failed to uphold crucial regulations designed to protect the lives and physical well-being of patrons at the bar. This failure could implicate both current and former council staff.

In a statement, the Morettis expressed their “indescribable grief” over the tragedy and have committed to cooperating fully with all investigative efforts. The fire has not only shattered lives but also stands as one of the most catastrophic events in recent Swiss history, marking a significant blow to the country’s international reputation, as noted by Alexandre Edelmann from Presence Switzerland.

Why it Matters

The Crans-Montana fire serves as a grim reminder of the critical importance of rigorous safety standards and the accountability of both public officials and private business owners. As investigations unfold, the focus will be on ensuring that such a tragedy is not repeated and that the victims’ families receive justice. The implications of this incident extend beyond local borders, raising concerns about fire safety regulations in public venues worldwide and prompting a reevaluation of enforcement practices to safeguard against future disasters.
