A disqualified driver has received a 13-and-a-half-year prison sentence after he caused the tragic death of a 74-year-old great-grandfather by crashing a stolen supercar into a residential garden. John Bell was working in a neighbour’s garden in Broughty Ferry, near Dundee, when he was struck by the vehicle driven by Fraser Garden, 55, on 13 April this year. The incident highlights the dangers posed by reckless driving and the severe consequences of disqualified individuals operating vehicles.
Tragic Incident Unfolds
John Bell sustained catastrophic injuries when he was hit by a Maserati that Garden had stolen earlier that day. The impact was so severe that Mr Bell was pinned against the wall of a nearby house, resulting in injuries deemed “non-survivable” by medical professionals. Mr Bell, a devoted family man, is survived by three children, ten adult grandchildren, and nine great-grandchildren, leaving a profound void in their lives.
Fraser Garden, who had a lengthy criminal history consisting of 90 previous convictions—many related to driving offences—pleaded guilty to multiple charges, including causing death by dangerous driving. His reckless behaviour on the day of the incident was exacerbated by the fact that he was not only driving without insurance but was also disqualified from operating a vehicle at the time.
A Reckless Pursuit
On that fateful day, Garden entered a car showroom in Broughty Ferry and stole the high-performance Maserati, valued at a staggering £100,000. Witnesses reported that he drove the car at alarmingly high speeds—exceeding 80 mph in a 30 mph zone—while committing a series of traffic violations. He jumped red lights, overtook vehicles into oncoming traffic, and drove on the wrong side of the road. The chaos ended when he lost control of the vehicle, veering off the road and crashing into the garden where Mr Bell was working.
Prosecutor Graeme Jessop KC revealed in court that just moments before the crash, Garden was travelling at 85 mph and that the Maserati was still moving at 34 mph upon impact with the house. Garden’s immediate response to police, when apprehended, was a simple “Sorry,” demonstrating a lack of understanding of the gravity of his actions.
Court Ruling and Sentencing
During the sentencing at the High Court in Edinburgh, the court heard that Garden had been under three separate disqualifications from driving when he committed the fatal act. The judge expressed concern over Garden’s blatant disregard for the law and the tragic outcome of his reckless decisions. In addition to the custodial sentence, he was also held accountable for theft of the vehicle, driving without insurance, and failing to provide a blood sample for testing.
The Maserati, boasting 523 horsepower and capable of accelerating from 0 to 60 mph in just 4.6 seconds, was a powerful vehicle that Garden was ill-equipped to handle responsibly, given his extensive history of driving offences.
