This initiative aims to assist individuals who have been misled by unscrupulous agents, including those selling fictitious job opportunities in Canada. Regulatory Framework Under Development

Earlier this month, Ottawa issued directives to implement regulations that will govern the operation of the compensation fund. Currently, individuals can lodge complaints with the CICC, which has the authority to levy fines against consultants found guilty of misconduct. However, the introduction of a compensation fund will offer a new layer of protection for those adversely affected by fraudulent practices.

CICC spokesperson Stef Lach expressed optimism about the new regulations, stating that the college is preparing the necessary operational and governance structures to ensure effective administration once the fund is operational from July 15, 2026. Lach reiterated that the framework aims to bolster public confidence by ensuring that licensed consultants adhere to established standards of professional conduct.

The compensation fund will be financed through fines imposed on consultants who violate regulations, as well as fees collected from licensed practitioners. Despite the potential benefits of the fund, some critics, including Toronto immigration lawyer Ravi Jain, argue that this measure is merely a temporary fix to a more systemic issue within the industry.

Jain described the initiative as a “band-aid solution,” emphasising that while many immigration consultants are diligent, the profession would be better served if consultants were required to collaborate with licensed lawyers. He stressed that the legal complexities of immigration processes often exceed the expertise of even reputable consultants, leaving clients vulnerable to misinformation and poor advice.
